A brief overview of New York divorce

In 2010, New York became a no-fault state. A spouse can petition for divorce by attesting that the marital relationship has been irretrievably broken for at least six months. This prevents the petitioner from having to prove other grounds, which could damage that person’s reputation, and waiting throughout a prolonged separation. But filing no-fault does not guarantee an amicable or uncontested divorce. There are many issues that the couple must resolve, including:

  • Division of Assets, including property and investment accounts
  • Division of Debts, including mortgages and other liabilities
  • Child Custody
  • Child Support
  • Spousal Maintenance or Alimony

Couples who negotiate a settlement for these aspects of their divorce can present the court with a settlement agreement. If the court approves, the uncontested divorce is final. A disagreement, however, on any single issue could obstruct the process, leading to a contested divorce. That can mean further negotiation, mediation, or litigation of these issues in court.
