How Divorce Mediation Works in New York — A Step-by-Step Guide

New York State supports divorce mediation as a recognized alternative to litigation, and Nassau and Suffolk County courts actively encourage couples to explore it before proceeding to trial. Here’s what you can expect when working with Simonetti & Associates:

Step 1: Initial Consultation Both spouses meet with one of our mediators at our Syosset or Water Mill office. This session is an opportunity to understand how mediation works under New York law, ask questions, and determine whether mediation is the right fit for your situation. No decisions need to be made at this stage.

Step 2: Identifying the Issues The mediator works with both parties to identify all issues that need to be resolved, which, under New York law, typically include:

Equitable distribution of marital assets and debts (New York is an equitable distribution state, meaning assets are divided fairly, not necessarily equally)
Child custody and parenting time arrangements
Child support, calculated in accordance with New York’s Child Support Standards Act (CSSA)
