Serving Massapequa since 1990

Our founding partner, Louis F. Simonetti, Jr., is a lifelong Long Island resident who started the firm in 1990. Our attorneys focus on divorce, divorce mediation and other family law matters, and we represent clients throughout Nassau and Suffolk County, including Massapequa, Massapequa Park and the surrounding South Shore communities.

Massapequa is in Nassau County, so a Massapequa divorce is heard at the Nassau County Supreme Court’s Matrimonial Center. Since June 2025, matrimonial cases have been heard at the court complex at 101 County Seat Drive in Mineola. Our office in Westbury is a short drive from both Massapequa and the courthouse.

An attorney you can reach

Frequent contact with your attorney matters for your peace of mind during a divorce. We keep flexible office hours, meet with clients virtually, return calls after hours and offer a free consultation in every case.

Ways we keep your costs down

Mediation. Divorce trials are expensive, so we offer mediation services and help clients who want to try this alternative to drawn-out litigation.

Efficient discovery. We use cost-effective discovery tools to get the financial information your case needs.

Focused trials. When a trial can’t be avoided, we look for ways to present your case fully to the judge while keeping it as short and efficient as possible.

What has to be resolved in a New York divorce

New York has allowed no-fault divorce since 2010. A spouse can file by stating that the marriage has been irretrievably broken for at least six months, without proving the other spouse did anything wrong. Filing no-fault doesn’t make a divorce amicable, though. You and your spouse still need to resolve:

If you agree on all of these, you can submit a settlement agreement and proceed with an uncontested divorce. A disagreement on any single issue makes the divorce contested, which can mean further negotiation, mediation or litigation in court.

Unhappy with your current divorce attorney?

Many people trying to end one frustrating relationship end up in another, with their divorce lawyer. If you feel your current attorney isn’t serving you, switching is easier than you might think. You don’t have to make the uncomfortable phone call; we’ll handle it for you and help you transition smoothly to our firm.

Massapequa divorce questions

Who can file for divorce in New York?

At least one spouse must meet the residency rules. You can file if either spouse has lived in New York continuously for at least two years, or for one year if you married in New York or lived here as a married couple. Same-sex couples divorce under the same rules.

Do I have to prove fault to get a divorce?

No. In a no-fault case, the grounds are that the marriage has been irretrievably broken for at least six months. Read more about grounds for divorce in New York.

Do I need a lawyer?

You aren’t required to hire one, but a good divorce lawyer can save you time, money and frustration in the long run.

What if I can’t pay my bills during the divorce?

While the divorce is pending, the court can order temporary child support or temporary spousal maintenance until it issues a final judgment.

How is custody decided?

Judges look at each parent’s bond with the children, who has been the primary caregiver, which parent is more likely to encourage the children’s relationship with the other parent, and whether each parent can care for the children. Domestic violence, neglect or abuse can weigh heavily against a parent.

My spouse won’t let me see our children. What can I do?

We can ask the court for an order of temporary custody or visitation while the divorce is pending. Doing nothing risks letting your relationship with your children deteriorate.

Can a divorce agreement be changed later?

Yes. If your circumstances change substantially, you can ask the court to modify your settlement agreement or divorce judgment.
