Big Win for Eric Mueller of Simonetti & Associates in “Business Divorce” Case
Prominent Long Island Lacrosse Club Fallout Turns in Favor of Defendant
A coach’s motion for a preliminary injunction against his partners in a prominent Long Island lacrosse club was denied by Suffolk Commercial Division Justice Emily Pines. Simonetti & Associates represented the defendants who along with the plaintiff formed the well known Long Island Express Lacrosse LLC in January 2005.
Reviewing the affidavits submitted by Allen’s accountant, and responsive affidavits from the business’ accountant and its attorney, Pines decided in an Oct. 30th judgement that because the facts were “highly disputed,” the injunction was “simply not warranted under these circumstances.” “Judge Pines not only denied Jamie Allen’s request for injunctive relief, but also vacated the restrictions on the majority members ability to run the Long Island Express. The decision underscores the highly speculative nature of Mr. Allen’s claims, the fact that Mr. Allen’s claims lack factual basis and the fact that it is my clients who are in the best position to run the LI Express” Said Simonetti.
